Who Qualifies for Asylum?
You may be eligible for asylum if you:

The Two Types of Asylum: Affirmative & Defensive
There are two primary ways to apply for asylum in the U.S.:
π Affirmative Asylum (Applying Proactively through USCIS)
Individuals who are not in removal proceedings can apply for asylum directly through USCIS by submitting Form I-589 (Application for Asylum & Withholding of Removal).
- You do not need a sponsor and can apply regardless of your immigration status.
- If USCIS denies your asylum application and you do not have legal status, your case is referred to immigration court, where you can renew your asylum request in front of a judge.
π Defensive Asylum (Applying in Immigration Court)
If you are already in removal proceedings, you can apply for asylum as a defense against deportation. This happens when:
β You were referred to immigration court after a denied affirmative asylum application.
β You were apprehended at the U.S. border and placed in removal proceedings after passing a credible fear interview (CFI).
β You were placed in deportation proceedings for another reason and seek asylum as a form of relief.
